I do believe justice is mixed when a defendant is allowed to plea bargain. There are many good opportunities to do so. Here are some of the good opportunities for agreeing to a plea bargain.
Many defendants before they go to court are vey anxious. They simple do not know what they outcome will be if the case goes to court. So the defendant simply takes a plea bargain so they will know what will happen oppose to sitting through trail and not know what is going to happen.
Many defendants obviously do not want to go to jail. So they will sign a plea agreement to stay out of jail so they can stay home with their families.
Many defendants take a plea agreement to reduce their charges. A lesser charge looks better on their record.
Many defendants take a plea agreement to reduce their sentence. The difference could be years. This is very important when you are facing prison time.
Many defendants take the plea agreement just to solve the issue quickly and move on.
Many defendants take the plea agreement to avoid all the hassles that go along with going to court – time ,money,etc.
Why are plea bargains so popular? For the defense attorneys, it means maybe saving their client from more serious charges and jail time. For defendants, it often means receiving a reduced sentence and resolving the issue faster.
It seems that plea bargains are used over justice because it is easier, it saves time and money. It is not true. Every case simply can not go to trail. The court would be overloaded and we just do not have enough manpower for that. Plea bargains are a good deal for a lot of cases. I truly believe that defendants agree to plea agreements out of fear or they just do not know what they are doing. If that is case no one receives justice the defendant or the justice administration.
